Chairman Mark Masinda called the Public Hearing to order at 7:30 PM.

PUBLIC HEARING:
1. ZBA2015-8 Amend Special Exception Application (ZBA2014-12) expanding retail space 148 River Road (Map 15 Lot 27 Zone R80) Owner: Kosowicz Family Living Trust Applicant: Carol Lee (Received November 12, 2015 Public Hearing or decision by January 14, 2016)
Carol Lee was present to speak about her application. She said that she is using space in the Over the Creek antique shop, and that she would like to increase her space to the building next door.
Richard Maloney reviewed the file; he said it contained approval from EHHD and receipt of abutters, and a map showing the location of the building. C. Lee said that the Zoning Agent asked the Building inspector and Fire Marshall to look at the location.
M. Masinda closed the Public Hearing.
2. ZBA2015-7 Notice of Appeal of a Cease and Desist Order issued by Zoning Agent at 380 Daleville Road (Map 2 Lot 001 Zone R80) Owner/Applicant: Willington Oaks, LLC c/o Steven Miles (Received June 29, 2015 Public Hearing September 10, 2015 Decision within 65 days after close of P. H.)
M. Masinda stated that no one was present for the applicant. Discussion continued on the application. R. Maloney said that he did go to see the property, and the trailer is still there, he said it did not look like it was being used. A. Poole said she had listened to the recording of the October 8, 2015 meeting.
R. Maloney said that a Cease and Desist Order dated May 29, 2015 was sent to Willington Oaks, LLC c/o Steven Miles. He filed a Notice of Appeal on June 29, 2015.
R. Maloney motion to close the Public Hearing. M. Masinda seconded the motion. All voted in favor.
Regular Meeting:
Chairman M. Masinda called the regular meeting to order. Members present as above.
Old Business:
1. ZBA2015-10 Amend Special Exception Application (ZBA2014-12) expanding retail space 148 River Road (Map 15 Lot 27 Zone R80) Owner: Kosowicz Family Living Trust Applicant: Carol Lee (Received November 12, 2015 Public Hearing or decision by January 14, 2016)
R. Maloney motion to amend the Special Exception dated December 14, 2006 and any subsequent Special Exception to include the out building at 148 B River Road. The amendment applies only to the out building in application ZBA2015-10. William Bland seconded the motion. All voted in favor.
2. ZBA2015-7 Notice of Appeal of a Cease and Desist Order issued by Zoning Agent at 380 Daleville Road (Map 2 Lot 001 Zone R80) Owner/Applicant: Willington Oaks, LLC c/o Steven Miles (Received June 29, 2015 Public Hearing September 10, 2015 Decision within 65 days after close of P. H.)
R. Maloney motion to uphold the Cease and Desist order issued by the Zoning Agent on May 29, 2015. John Rup seconded the motion. M. Masinda asked for any discussion. Members talked about the property being non-conforming. Having a trailer on the property made it more non-conforming. All voted in favor.
R. Maloney motion to approve the minutes of November 12, 2015 with a correction to the application number ZBA2015-8 to the correct number of ZBA2015-10. A. Poole seconded the motion. All voted in favor.
Annemarie Poole motion to adjourn the meeting.
